Terms of Service
Effective and last updated:
This is a translation of the Thai version. If they differ, the Thai version prevails.
These terms are an agreement between the user and GN Collage ("we") for using gncollage.com, event galleries and related services (the "Service"). Signing in or using the Service means accepting these terms and the Privacy Policy.
1. Definitions
- User: a person or organization that signs in and creates events, such as a photographer or organizer
- Guest: a person who opens an event gallery through a QR code or link
- Event: an event page a user creates and links to a Google Drive folder
- Content: photos, text, logos and data a user brings into the Service
2. Accounts
- Users sign in with a Google account and must provide accurate information.
- Users keep their account secure and are responsible for all activity under it.
- The number of devices signed in at once follows the package. Beyond that, other devices may be signed out.
- Tell us at once about any unauthorized access to an account.
3. Packages and the trial period
- The Service is currently in a trial period and every package is free of charge.
- Event count, device count and available features follow the package the user has.
- We may change packages or prices, or end the trial period, with notice in the Service or on the pricing page before any charge begins. We will not charge a user without their consent.
- When a package no longer includes a feature, that feature turns off and related data, such as face data, may be deleted.
4. Using Google Drive
- Event photos come from the Google Drive folder the user links. The Service reads and caches them to show the gallery.
- The Service creates folders or moves them to the bin only when the user asks, and does not modify original files.
- Syncing depends on Google Drive and the access the user grants. If access is revoked, syncing stops.
- The Service is not a backup system. Users should always keep original files in Google Drive or elsewhere.
5. Content and rights in photos
- Users own their content.
- Users permit us to store, copy, resize, convert, watermark, run face processing on and show content to people with the QR code or link, only to provide the Service. This permission ends when the content or account is deleted.
- Users confirm they hold the rights to their content and have notified or obtained consent from people in the photos as the law requires, including before turning on Face Search and where minors appear.
- Users are responsible for claims arising from content they bring in.
6. Galleries and sharing
- A gallery can be opened by anyone with its QR code or link. There is no public event search.
- Users are responsible for how they hand out QR codes and links. Guests who open a gallery can view and save photos.
- Watermarks show credit but cannot fully prevent copying or sharing.
7. Prohibited use
- Content that is illegal, infringes copyright or violates others' privacy
- Obscene content, sexual content involving minors, or content promoting violence or hatred
- Using Face Search to track, monitor or identify people without the right to do so
- Accessing others' systems or data without permission, penetration testing, or disrupting the Service
- Bulk automated scraping, reverse engineering, or reselling the Service without permission
8. Service provision
- The Service is provided as is and may pause for maintenance or fixes.
- How fast photos appear depends on Google Drive, network signal and file size.
- Face Search may miss some photos or occasionally show a photo that does not match.
- We may add, change or remove features, with notice for material changes.
9. Intellectual property in the Service
The Service's software, design, logos, marks and documentation belong to us or our licensors. These terms do not transfer those rights to users.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect or special damages, lost profits or lost data. Our total liability does not exceed the fees the user paid in the 12 months before the event giving rise to the claim. This does not limit consumer rights that the law does not allow to be excluded.
11. Suspension and termination
- Users can stop using the Service and ask for account deletion at any time through the contact channels.
- We may suspend or terminate accounts that breach these terms or put the Service or others at risk.
- After termination, data is handled as described in the Privacy Policy.
12. Reporting content
Anyone who finds content that infringes copyright or privacy or is otherwise inappropriate, including guests who want their photos removed, can report it with the gallery link through the contact channels. We review reports and coordinate with the event owner.
13. Changes to these terms
We may update these terms and will change the date above. Material changes are announced in the Service or by email before they take effect. Continued use after that means accepting the new terms.
14. Governing law
These terms are governed by Thai law and disputes fall under the jurisdiction of Thai courts. If a translation conflicts with the Thai version, the Thai version prevails.
